Dangote Petroleum Refinery and Petrochemicals filed a lawsuit, which three oil entrepreneurs—AYM Shafa Limited, A. A. Rano Limited, and Matrix Petroleum Services Limited—have petitioned the Federal High Court in Abuja to disregard.
Oil marketers contended in a mixed counter-affidavit, in response to an originating summons filed with the aid of Dangote Petroleum Refinery and Petrochemicals, that approving the refinery’s application could be disastrous for the country’s oil industry.

In its first summons dated September 6, 2024, Dangote Refinery had sued Nigeria National Petroleum Corporation Limited and the Nigeria Midstream and Downstream Petroleum Regulatory Authority.
The refinery asked the court to rule that by granting licenses for the importation of petroleum products, NMDPRA had violated Sections 317(8) and (9) of the Petroleum Industry Act (PIA).
It said that these licenses should only be granted when there is a shortage of petroleum products.
Additionally, it asked the court to rule that NMDPRA’s failure to support regional refineries like the firm violates its statutory obligations under the PIA.
However, Shafa, A. A. Rano, and Matrix Petroleum retorted that the Dangote refinery does not provide enough petroleum products for Nigerians’ everyday consumption.
They pointed out that the plaintiff had not presented the court with any evidence to the contrary.
They maintained that, in accordance with Section 317(9) of the PIA, they are eligible and well-qualified to receive an import license from NMDPRA to import petroleum products into Nigeria.
Additionally, they stated that they are completely eligible to receive the import licenses that the first defendant granted them because they fulfilled all legal conditions for such licenses prior to receiving them.
